Nexion Health
Nexion Health Management, known more commonly as Nexion Health, comprises a large network of skilled nursing facilities that provide rehabilitation services.
While Nexion Health’s headquarters are in Maryland, its 56 facilities operate in Louisiana, Mississippi, and Texas, and it is known as a local leader in nursing homes in these states. The healthcare company has even started the Nexion Foundation and started the Barbara Hair Excellence Through Education Scholarship Program.
The facilities they operate have between 54 and 182 beds. Nexion Health was founded in 2000 by Francis Kirley, whose vision was to create rehabilitation facilities, assisted living facilities, and home care services that provide the utmost care to those requiring a range of healthcare services.
Each rehabilitation facility has its own Medicare rating, but the ratings vary below and above average throughout Nexion Health’s 56 facilities. The Centers for Medicare and Medicaid Services (CMS) rates each facility based on its health inspections, staffing levels, and quality of care. So, it is ideal to look into the specific Nexion Health facility for its Medicare rating.
While most of their facilities don’t have any significant issues, several issues have occurred throughout Nexion Health properties.

Complaints and Legal Actions Against Nexion Health
Every healthcare facility is different when it comes to complaints. What some employees or residents complain about at one Nexion Health facility might not be the same complaints another resident has at a different facility.

Lawsuits Against Nexion Health
Not all complaints against Nexion Health facilities result in lawsuits, but with 56 facilities across three states, this healthcare company has been the subject of several notable lawsuits.
Smith v. Nexion Health at McKinney
In 2019, Marcus Smith filed a medical malpractice lawsuit against McKinney Healthcare and a Rehabilitation Center in McKinney, Texas, on behalf of his deceased mother, 91-year-old Celia Smith.
Celia was a resident of this Nexion Health facility with a history of dementia, transient ischemic attack (TIA), and hypertension.
She was receiving speech, occupational, and physical therapy while at McKinney Rehab, as well as pain management, assistance with activities of daily living, and preventative skin care. Celia was first admitted to the hospital in March of 2019 and then frequently in and out of the hospital due to infectious diseases, untreated UTIs, and incorrect medication management.
On her third visit to the hospital in one month, Celia was in respiratory distress and suffered cardiopulmonary arrest before passing away. Marcus filed his lawsuits on the grounds of nursing staff and other employees not following physician orders, not implementing nursing interventions, and not performing or reporting nursing assessments. Ross v. Nexion Health at Duncanville
Upon the death of her father, Connie Horsley, in 2012, Frankie Ross filed a lawsuit against Duncanville Health Care and Rehabilitation Center. Horsely was living at the Nexion Health facility in Duncanville, Texas, at the time of his death.
The lawsuit against Nexion Health covered several areas of negligence that can be directly connected to the resident’s passing. Ross states in her petition that the facility and employees were negligent and grossly negligent, resulting in a fall that caused a head injury. The negligence that Ross cited in her petition against the company included:
- Failing to perform medical treatment properly
- Failing to fully disclose the risks of not having an injured resident immediately examined by a healthcare professional
- Failing to consult a neurologist who is better equipt to assess head injuries
- Employees failing to observe significant changes in the resident’s behavior and condition
- Failure to meet the acceptable standards of care
Nexion Health filed a motion to dismiss the allegations. Still, the courts only rejected the allegation that they failed to recognize symptoms of the patient’s fall and failed to inform the family of Horsely’s actual physical state. [2]
Taylor v. Nexion Health at Pierremont
Another lawsuit against Nexion Health comes from one of their South Louisiana facilities in Shreveport. The four children of resident Delores Jean Bogan, Yolanda Taylor, Catina Smith, Cynthia Smith, and Vernaon Taylor, filed a personal lawsuit individually and on behalf of their mother after her passing in 2015.
The primary basis of their case was that Pierremont Healthcare Center failed to send the correct chart with Bogan to the hospital, delaying the necessary care for her complex medical history, which resulted in a loss of chance of survival. Bogan was unconscious for almost an hour before being sent from the nursing home to the hospital with the wrong chart, resulting in the hospital labeling her “Jane Doe.”
Her family members arrived at the hospital, where they were told their mother wasn’t a patient because they weren’t aware they had the wrong chart.
Bogan was identified as the woman in the chart the Nexion nursing home sent, resulting in incorrect care for her condition, and she passed away the following day. The trial featured several expert witnesses, and Nexion was found guilty and compensated by paying damages of $150,000 to the plaintiffs. [3]
Inspection and Deficiency Reports at Nexion Health
CMS rates all Medicare and Medicaid facilities and provides regular inspection and deficiency reports so residents and their loved ones can stay informed about the status of each facility. While many facilities offer fantastic rehabilitation services and have great staff members who love their jobs, there are still issues.
Here are some notable inspection and deficiency reports at different Nexion Health nursing homes in the three states where the company has rehabilitation services:
- Pierremont Healthcare Center (Louisiana) – 10/12/2023 Issue Summary:
- Violation: The employees in this building were found to have failed to ensure safe medication administration practices. This includes offering the patient oral medications, providing water, and staying with them until the medication has been taken.
- Example: The inspection revealed that two patients were affected by this negligence. Staff are supposed to wait for the patient to take the medication, but cups of medication were found at the bedside of two patients who were told to wait until breakfast to take the medicine. Employees failed to do their job. [4]
- Duncanville Healthcare and Rehabilitation Center (Texas) – 05/24/2023 Issue Summary:
- Violation: Failing to obtain and provide food from an approved or satisfactory source, as well as failing to store, distribute, and prepare food by safety standards.
- Example: Some of the specifics of this violation include not throwing away expired food, not storing refrigerated food in the fridge, not documenting when certain foods were opened and stored, and leaving several food items open to the air. [5]
- Holly Springs Rehabilitation and Healthcare Center (Mississippi) – 01/04/2024 Issue Summary:
- Violation: Failing to keep the nursing home free from hazards that can cause accidents or provide appropriate supervision to prevent accidents.
- Example: Through interviews with Nexion Health staff and residents, we learned that this facility didn’t provide supervision for residents who smoke, failed to secure smoking materials from those who don’t smoke, and failed to ensure that doors where residents went to smoke, were closed correctly every time they entered and left the building.
